Summary of recent tenancy reforms for landlords and agents
Effective from July 1, 2024, South Australia's rental laws have been modernised to better protect renters while ensuring landlords can still manage properties efficiently. Key changes include:
- Termination of Tenancies:Tenancies can no longer be ended without a valid, prescribed reason. Valid reasons for termination now include needing the property for personal use, planned renovations, or sale (as per below).
- Minimum Housing Standards:New requirements ensure that properties meet minimum standards for safety, cleanliness, and habitability at the start of each tenancy.
- Drug Testing and Remediation:There are now specific regulations for testing properties for drug contamination and steps required for remediation.
- Alterations and Pets:Tenants now have more rights to make minor alterations and keep pets, with certain conditions.
- Domestic Abuse Protections:Enhanced protections for tenants experiencing domestic abuse, including the ability to terminate leases early without penalty.
- Privacy and Property Rights:New rules restrict landlords' access to tenants’ private information and set clear guidelines on entering rental properties.
- Rent and Inspections:Regulations have been updated on rent increases, inspections, and maintenance responsibilities to ensure fairness and clarity.
New evidence requirements for rental terminations
Recent changes to the Residential Tenancies Act 1995 has introduce stricter evidence requirements for landlords terminating tenancies. Here are the essentials:
- Demolition required:Demolition permit and a contract with a builder.
- Repairs/Renovations required:Photos, written statement, and either a tradesperson’s quote or a building permit.
- Landlord/Family Occupancy required:Statutory declaration stating who will move in and no new tenancy within six months.
- Sale of Property required:Signed contract of sale.
